A divorce calls for both spouses to separate a life that they brought together over a period of time. During this time, what is known as the division of assets takes place. This divides the couple’s assets between the two of them before they can be officially divorced. Often times when facing these matters, spouses wonder what they are entitled to receive. What is Litigation?

What Assets are Subject to Equitable Distribution?

No one is usually very willing to give up assets that they acquired and valued over time. This makes the division of assets fairly difficult during a divorce. In order to divide assets fairly, the court determines what is marital property and what is separate property. Marital property consists of assets that are acquired during the marriage. Separate property consists of assets that were acquired before the marriage that were never converted to marital property.
